1. Purpose
These Terms of Use ("Terms") govern access to and use of the GolfSpec Pro service (the "Service"), a SaaS platform for managing the business of golf-fitting shops and professionals, published by [TO CONFIRM: company name] ("GolfSpec") and available at golfspecpro.app and through the GolfSpec Pro iOS app.
They apply to the professional holding the account (the "Shop") and to each member of its staff with access (the "User"). Commercial terms (plans, prices, invoicing, cancellation) are set out in the Terms of Sale, which supplement these Terms.
Signing up implies acceptance of the Terms and the Terms of Sale. The date of acceptance and the version accepted (currently "2026-09-14") are recorded on the Shop's account.
2. Description of the Service
Depending on the plan subscribed, GolfSpec Pro offers golf-fitting professionals:
- creation and follow-up of fittings: interview, measurements, clubs tested, recommendations, quotes and PDF documents;
- import and analysis of launch-monitor data (CSV files, TrackMan reports by link);
- artificial-intelligence features to support decision-making (section 8);
- a customer portal to view recommendations, message the fitter and pay online;
- customer–fitter messaging with attachments;
- appointment management, with a public online-booking page;
- a workshop module (repair tickets, steps, photos, signatures, parts and services) and an after-sales module (claims to suppliers);
- collection of the Shop's customer payments through Stripe Connect (section 7);
- financial and statistical reporting and automatic reminders (regripping, satisfaction);
- multi-site management for chains;
- integrations with third-party tools (CRM) enabled at the Shop's request.
The content of each plan and its quotas (fittings per month, sites included) are described in the Terms of Sale and on the Subscription page. The iOS app is used to sign in to existing accounts; sign-up and subscription take place on the website.
3. Registration and account
Registration is reserved for professionals (legal entities or sole traders) acting in the course of their business. The Shop undertakes to provide accurate information and to keep it up to date.
The account administrator may invite staff members and assign them a role (administrator, manager, fitter) and, where relevant, a site. Each login is strictly personal: the User is responsible for keeping their credentials confidential and for any activity carried out from their account. The Shop is liable for the actions of its Users.
The Shop shall notify GolfSpec without delay of any unauthorised use of its account, at the address given in section 17.
4. Free trial and subscription
The Service offers a 14-day free trial, with no credit card required, giving access to all features (equivalent to the Full plan, 3 sites included).
At the end of the trial, the Shop may subscribe to one of the plans offered (Basic, Pro, Full), billed monthly or yearly. Prices, the first-year rate, card payment through Stripe, automatic renewal, plan changes and cancellation are governed by the Terms of Sale.
If no plan is subscribed at the end of the trial, access to the Service is suspended until a plan is subscribed; the account's data remain available for export and deletion under section 6.
5. Additional sites
Paid plans include one site. A Shop with the multi-site feature may add further sites, billed at the rate stated in the Terms of Sale according to the billing period of its subscription (monthly or yearly); the billed quantity is adjusted automatically when a site is added or removed. Creating a site requires an active subscription or an ongoing trial.
6. Shop data: ownership, export, deletion
The Shop remains the owner of all data it enters or imports into the Service (customers, fittings, measurements, photos, messages, products, documents). GolfSpec uses them only to provide, secure and improve the Service, under the conditions of the Privacy Policy and the Data Processing Agreement.
The administrator may at any time export the account's main data in JSON format (shop, sites, users, customers, fittings and quotes, appointments, conversations, goals, products), as well as an accounting export in CSV format. Some data (workshop tickets, after-sales claims, email log) are not included in the JSON export [TO CONFIRM: final scope of the export].
The administrator may request deletion of the account from the settings (password confirmation). Access is maintained for 30 days, during which the request can be cancelled; after that period, all account data are permanently deleted from the production database. Encrypted database backups are kept for 30 days (90 days for the monthly backup) before expiring in turn. A deletion request ends the subscription at the end of the current billing period [TO CONFIRM: exact behaviour configured in Stripe].
7. Payments through Stripe Connect
The Shop may connect a Stripe account to the Service (Stripe Connect) in order to collect payments from its own customers: online payment of a quote from the customer portal, deposits and card pre-authorisations when booking. Funds are collected directly by the Shop on its Stripe account: GolfSpec is neither a party to the contract between the Shop and its customer nor a custodian of the funds, and stores no card data.
The relationship with Stripe is governed by Stripe's terms, accepted by the Shop when activating the connected account. The Shop is solely responsible for its terms of sale towards its customers (including its cancellation policy, shown to the customer before payment), its prices, its invoicing and refunds. 8. Artificial intelligence
Some features of the Service rely on an artificial-intelligence model provided by Google (Gemini): structured analysis of a fitting and suggested recommendations, session assistant, drafting of a fitting summary, and draft replies in the messaging module (which the Shop can enable or disable).
These features are decision-support tools. Their output may be incomplete or wrong and must be checked by a professional before any use: the fitter remains solely responsible for the recommendations given to the customer and for the messages sent. GolfSpec does not warrant the accuracy or relevance of generated content.
The data sent to the model and the conditions of their processing are described in the Privacy Policy. The Shop may customise the instructions given to the model and disable AI drafts. Use is subject to a daily cap on analyses per account and to rate limits, to preserve the availability of the Service for everyone.
9. Personal data
For the data of its own Users (staff accounts, billing, support), GolfSpec acts as a data controller. For the data of end customers that the Shop enters into the Service, GolfSpec acts as a data processor, on the Shop's instructions; the Shop remains the controller.
Processing is described in the Privacy Policy; the mutual processing obligations (instructions, security, sub-processors, assistance with data-subject rights, fate of the data) are set out in the Data Processing Agreement (DPA), which forms an integral part of these Terms.
The Shop undertakes to have a legal basis for the data it enters, to inform its customers and to collect only the information needed for the fitting. The interview may include information about physical constraints: the Shop shall record them only with the customer's agreement and to the extent useful for the recommendation [TO CONFIRM: handling of health data, Art. 9 GDPR].
10. Acceptable use
The User shall not use the Service for unlawful purposes, compromise its security or integrity (unauthorised access attempts, circumvention of usage limits, automated extraction), upload unlawful or infringing content, or use the messaging or reminder features to send unsolicited messages. Uploaded content (photos, attachments, receipts) remains the responsibility of the Shop.
11. Availability of the Service
GolfSpec uses reasonable endeavours to keep the Service accessible 24/7, as a best-efforts obligation. No quantified availability level is guaranteed under these Terms [TO CONFIRM: any service-level commitment in the Terms of Sale].
GolfSpec may temporarily interrupt the Service for maintenance or updates; planned operations are announced in advance where possible. GolfSpec shall not be liable for interruptions due to force majeure, communication networks or the failure of its providers (hosting, database, payments, artificial intelligence, email delivery).
The database is backed up daily in encrypted form and restoration is tested periodically. The Shop remains responsible for exporting its data regularly.
12. Liability
The Service is provided "as is". GolfSpec uses reasonable endeavours to ensure its security and reliability, without guaranteeing the absence of any malfunction or the suitability of the Service for a particular need.
The Shop is solely responsible for its use of the Service, for the recommendations, quotes, invoices and documents it generates for its customers, and for compliance with its own obligations (tax, accounting, commercial). GolfSpec shall not be liable for indirect losses (loss of revenue, customers or data not exported).
GolfSpec's liability is limited, for all losses combined, to the amounts paid by the Shop over the previous 12 months [TO CONFIRM: liability cap and professional indemnity insurance].
13. Intellectual property
The Service (code, interfaces, GolfSpec brand, content, knowledge base) is the exclusive property of GolfSpec or its licensors and is protected by intellectual-property law. The Shop is granted a personal, non-exclusive and non-transferable right of use for the duration of the subscription. Data and content entered by the Shop remain its property (section 6).
14. Cancellation and suspension
The Shop may cancel its subscription at any time from its Subscription area (Stripe billing portal); cancellation takes effect at the end of the current billing period, under the conditions of the Terms of Sale. Permanent deletion of the account follows the procedure in section 6.
GolfSpec may suspend access in the event of non-payment, and suspend or terminate an account in the event of a breach of these Terms, fraudulent use or a threat to the security of the Service, after notice by email except in urgent cases.
15. Changes to the Terms
GolfSpec may amend these Terms. Shops are informed by email of any substantial change at least 30 days before it takes effect. The version in force is dated at the top of the document [TO CONFIRM: re-acceptance process when a new version is issued].
16. Governing law and disputes
These Terms are governed by French law. In the event of a dispute, the parties shall seek an amicable solution; failing that, the courts of Toulouse shall have exclusive jurisdiction [TO CONFIRM: competent court according to the registered office].
